Obligations of economic operators concerning battery due diligence policies

The (EU) 2023/1542 amendments released in 21 May 2025, here are some critical points that all battery factories need to pay attention to

1. Key Amendments
  • Postponement of Effective Date: The implementation of battery due diligence policies (covering cobalt, natural graphite, lithium, and nickel supply chains) is delayed from 18 August 2025 to 18 August 2027.
  • Guideline Release Adjustment: The publication of due diligence guidelines is rescheduled from the original date of 18 February 2025 to 26 July 2026 to align with guidelines under the Corporate Sustainability Due Diligence Directive (EU) 2024/1760.

2. Reasons for Postponement
  • Supply Chain Complexity: Geopolitical shifts and challenges in raw material sourcing necessitate additional time for companies to analyze and adapt supply chains.
  • Insufficient Notified Bodies: Only half of EU Member States have designated authorities for conformity assessments, and the absence of standardized accreditation hampers third-party verification.
  • Immature Industry Standards: Industry-led due diligence schemes are still under development and require further refinement and EU recognition.
  • Regulatory Alignment: Ensuring coherence with Directive (EU) 2024/1760 to avoid conflicting compliance requirements.

3. Legal Basis
  • Article 114 TFEU: Ensures harmonization of the internal market, preventing fragmentation from divergent national rules.
  • Subsidiarity and Proportionality: The amendment adjusts timelines without altering substantive obligations, minimizing regulatory intervention.

4. Impact Analysis
  • For Businesses: A two-year extension allows companies to strengthen supply chain management, adapt to certification requirements, and reduce compliance cost pressures.
  • For Member States: Addresses delays in establishing notified bodies and compliance infrastructure.
  • Environmental Goals: While postponement may slow supply chain transparency, thorough preparation may enhance long-term effectiveness.

5. Financial & Administrative Implications
  • No Additional Budget: Only timeline adjustments; no new funding or human resource demands.
  • Guideline Synergy: Coordinated release of guidelines with Directive (EU) 2024/1760 fosters consistent implementation.

6. Next Steps
  • Legislative Process: Requires adoption by the European Parliament and Council, with urgent entry into force to ensure legal clarity.
  • Corporate Recommendations: Utilize the transition period to develop supply chain traceability systems, engage in industry due diligence schemes, and monitor guideline updates for compliance alignment.

Summary
This proposal addresses practical challenges in implementing the EU Battery Regulation, aiming to enhance the sustainability and competitiveness of the EU battery supply chain. Businesses should proactively prepare for compliance while awaiting finalized guidelines and regulatory alignment.
